These Terms of Use ("Terms") govern your access to and use of the website at unqoppub.com (the "Site"), operated by Unqualified Opinion Publishing ("we," "us," "our"), an independent press based in Windsor, Ontario, Canada. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
The Site is intended for users who are at least the age of majority in their jurisdiction, or who have the consent of a parent or guardian. By using the Site, you confirm that this is the case.
The Site and all of its content, including text, images, book covers, excerpts, design, code, logos, and the Unqualified Opinion Publishing name and feather mark, are the property of Unqualified Opinion Publishing or our authors, partners, and licensors, and are protected by Canadian and international copyright, trademark, and other intellectual property laws.
The works listed on the Site, including but not limited to Snip Season and Loomis & Flark, and any book excerpts, sample chapters, descriptions, and cover art, are protected works. All rights reserved.
You may view, share links to, and print pages of the Site for your personal, non-commercial use. You may not reproduce, copy, distribute, modify, adapt, scrape, mine, or create derivative works from any content on the Site, in whole or in part, without our prior written permission. You may not use any content on the Site to train machine learning or artificial intelligence models without our prior written permission.
When using the Site, you agree not to: use the Site for any unlawful purpose; attempt to gain unauthorized access to any part of the Site or its underlying systems; interfere with or disrupt the Site or the servers it runs on; introduce viruses, malware, or other harmful code; use any automated means to access the Site for the purpose of scraping, harvesting data, or training AI models; submit false, misleading, defamatory, harassing, or abusive content through the contact form; or impersonate any other person.
When you send us a message through the contact form or contact us about submissions, partnerships, or other inquiries, you confirm that you have the right to share the information you send, and that nothing you send infringes the rights of any third party. We are a small press and cannot guarantee that we will respond to every inquiry. Sending a manuscript or proposal does not create any obligation or business relationship between us unless we agree to one in writing.
If you send us an unsolicited idea, manuscript, or proposal, we will treat the contents with reasonable care, but we make no commitment of confidentiality, exclusivity, or compensation unless we agree to one in writing. Please do not send confidential or proprietary material through the contact form.
The Site may contain links to third-party websites, including retailers and reviewers. We provide those links for convenience. We do not control those sites and are not responsible for their content, privacy practices, or availability. Following a link to a third-party site is at your own risk.
The Site and its content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any information on the Site is complete, accurate, or current. Book descriptions, publication dates, and availability are subject to change.
To the fullest extent permitted by law, Unqualified Opinion Publishing and its owners, employees, contractors, and authors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or related to the Site will not exceed one hundred Canadian dollars (CAD $100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
You agree to indemnify and hold harmless Unqualified Opinion Publishing and its owners, employees, contractors, and authors from any claim, demand, or damages, including reasonable legal fees, arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
We may change, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Your continued use of the Site after changes are posted means you accept the updated Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in Ontario, without regard to conflict-of-law principles. You agree that any dispute arising out of or related to these Terms or your use of the Site will be brought exclusively in the courts located in Ontario, Canada, and you consent to the jurisdiction of those courts.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
